Terms of Use - BeClutch

By accessing or using the BeClutch mobile application and web-based services (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

1. Description of Service

BeClutch, owned by Sierralingo, LLC, provides mobile and web-based applications for sports teams, parks and recreation departments, and other groups. Services include communication, calendar management, surveys, volunteer coordination, facility rental, registration, and administrative tools.

2. User Accounts

You are responsible for maintaining the security of your account and password. Sierralingo, LLC cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

3. SMS Messaging & Team Communication (Opt-In)

By providing your mobile phone number and agreeing to these Terms of Use during registration, you provide your express consent to receive Email and SMS (text) messages from BeClutch and your associated organization.

What You Will Receive: You will receive team/group alerts and critical messages sent by your administrator, coach, or group leader.
Message Frequency: Message frequency varies and depends on the activity level of your coach, leader, or administrator.
Carrier Charges: Standard message and data rates may apply from your wireless carrier.
How to Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the number from which you received the message.
How to Get Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance.

4. User Content and Conduct

You retain all rights to the data you upload to BeClutch. However, you grant Sierralingo, LLC a license to host and display this data to your designated group members. You agree not to use the service for any illegal or unauthorized purpose.

5. Limitation of Liability

In no event shall Sierralingo, LLC be liable for any direct, indirect, incidental, or consequential damages resulting from the use or the inability to use the service.

6. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
